[NHCOLL-L:2370] Intellectual property rights and international specimens

Hi all

 

I was wondering if anyone had a standard memorandum of agreement document that they have drawn up that deals with the intellectual property rights as they pertain to specimens collected in foreign countries.  A number of foreign countries are now starting to put conditions on collecting within their countries dealing with the ownership of specimens and lodging of vouchers etc.  It is no longer safe to assume that your accessioning process gives you ownership of specimens collected in these countries and there is the potential for these countries to either wish to retain ownership of such specimens or reclaim ownership of specimens collected in the past.  There is also the potential for these countries to demand the repatriation of these specimens at any time.  This is a difficult situation to deal with, especially after vast amounts of investment have gone into the curation, accessioning, cataloging and storing of these specimens.  We are wanting to draft a standard MOA that would have the necessary information to handle such situations.  

 

If anyone has a document of this type that they would be willing to share with us I would appreciate it greatly.
