[Nhcoll-l] DwC Hour: Making DNA and tissue collections available

Hi all,

not only in the light of the very controversial discussions of digital 
sequence information to fall under Nagoya, my strong hope is that 
initiators fully understand the specific and exceptional data-release 
agreements of GBIF, as well as pertaining data protection, data privacy 
or other relevant laws such as species protection laws.

For example, placing just a cautious remark when offering DNAs or 
tissues of CITES or otherwise protected species is not enough to free 
data providers or hosting institutions from potential penalties and 
legal offence, if the "offering" itself is prohibited.

During ABS related discussions at the joined GGBN/SPNHC conference some 
had the strong belief that an open society has nothing to hide. Might be 
true to some extent. But not in all cases. There might be fine lines 
between online publication of observation data, object data and linkage 
of such data. Thus, linkage or dispersal of data should consider 
relevant regs, laws and agreements prior to publication, to protect 
both, publisher and provider from potential risks.

This might also include consideration of contractual clauses, which 
regulate under which conditions data are released or may be linked, or 
may explicitly exclude linkage of such data as in the case of GBIF and 
Europeana.

If this has been not considered yet, it might be worth exploring.
