<u>Overtime inspections and impact of sequester</u><br>
<br>
The USFWS Division of Law Enforcement issued a notice on 15 March
2013 regarding the impact of sequestration on clearance and
inspection at the ports:<br>

Subject: Update on Overtime Clearances<br>
<br>
Background: On March 11, 2013, we notified the trade of the effects
of sequester on overtime clearances for wildlife imports and
exports. We indicated that the U.S. Fish and Wildlife Service would
not inspect or clear any wildlife shipment on overtime hours as of
that date. Using overtime, which is funded by the importers and
exporters, we will continue to inspect and clear shipments.
Reductions required by sequestration will require staffing cut backs
and reductions in other spending areas. Requests for overtime
inspection services will be accommodated to the maximum extent
possible in order to protect wildlife and reduce the burden on the
trade. The hiring freeze that was noted previously in our March 11,
2013, public bulletin remains in effect. As the Service works to
implement the spending reductions required by sequestration, we
will continue to update the trade on any additional effects on port
operations.<br>

Action: Effective immediately, the Service wildlife inspection
offices will be authorized to perform overtime inspections when
personnel are available to do so.<br>
<br>
<i>What does this mean for you? </i><br>
<br>
In the past, if you were arriving at the port after regular business
hours, you could request clearance and inspection on an overtime
basis. You had to make these arrangements in advance and, of course,
be willing to pay for the overtime (<br>
<br>
The USFWS was not obligated to provide these overtime services; it
always depended on the availability of an inspector who was willing
to put in the overtime. <br>
<br>
Your other option was to wait for an inspector to arrive during
normal business hours, and to book your connecting flight (if any)
accordingly. <br>
<br>
This notice suggests that there will be no overtime inspectors
available, but then says that there will will be overtime inspection
if someone is available. Though this is a bit confusing, it sounds
as though it is going to be much less likely that someone will be
available. <br>
<br>
By the way, the OT fees are as follows:<br>

<u>Advance notice to the ports </u><br>
<br>
The designated wildlife ports (where you are supposed to come into
the U.S. whenever you have anything that requires a permit) are
supposed to have staff available M-F, 9-5 (or regular business
hours, which may vary slightly from one port to another), no federal
holidays. In theory, if you show up during those hours, and assuming
you have actually declared that you have wildlife products (a) on
line 11b of your CBP Customs form - that long blue form that you
fill in on the plane; (b) AND on a 3-177; and (c) AND when asked if
you have anything to declare, then you should be diverted to an AQI
(Agricultural Quarantine Inspector, i.e., the guys who used to be
APHIS) and the USFWS port inspector.<br>
<br>
As it happens, sometimes a USFWS port inspector is unavailable even
during the business hours, M-F, 9-5, no federal holidays. The
staffing shortages have made this problem more acute. <br>
<br>
At some airports, the airport logistics add a second challenge. For
instance, at JFK, international flights may arrive at one of several
international terminals and each of these terminals has its own
Customs checkpoint. The USFWS port inspector won't necessarily be
available to meet you and inspect your shipment unless you notify
them in advance of your planned arrival and then contact them (and
give them your contact information) before you arrive. <br>
<br>
The permit conditions on Migratory Bird Treaty Act permits mandated
48-hour notice prior to import. In 2012, the Ornithological Council
discussed this permit condition with the Division of Migratory
Bird Management, noting that it differed from the regulatory
provision. The Division of Migratory Bird Management thereupon
changed this permit condition (on Migratory Bird Import Export
permits; ESA and other permits may not have been changed so check
your permit carefully before you leave the U.S. - which you should
be doing anyway, if for no other reason than to be sure it won't
expire before you return!) was changed to read as follows:<br>

(b) <u>Import accompanying baggage language<br>
</u>If you plan to import dead, nonperishable specimens in your
accompanying or checked baggage, you must arrive at a designated
port of entry during normal business hours, Monday-Friday, and not
on Federal holidays. If you plan to arrive outside normal business
hours, or on a weekend or a Federal holiday, you must arrange in
advance for a USFWS Wildlife Inspector to be present and must be
willing to pay the overtime fees for this service. To arrange for

However, regulation and/or permit conditions require can
and do vary from REAL LIFE. <br>
<br>
In REAL LIFE, you really want to go the extra mile and do
things that may or may not be legally required because
doing so will make you own life easier.<br>
<br>
Therefore, we strongly suggest you do the following if you
are planning to bring your specimens with you (as opposed
to shipping):<br>
<br>
1. Always plan to fly into a designated wildlife port if
you are carrying any wildlife that requires a permit. It
is difficult at best to obtain a nondesignated port
exemption. There are rarely agents available to travel to
these ports and even if available, it can be quite costly
to you.<br>

2. Plan to arrive M-F, 9-5, no federal holidays. Always
leave adequate time between your arrival into the U.S. and
your connecting flight. <br>

3. Always plan to give at least 48 hours notice, whether
required or not.<br>

Obviously, when you are coming back from an expedition,
you have dozens of logistical issues on your mind.
Remembering to give 48 hours notice is just one more thing
that may be overlooked. So maybe you should give notice
before you even leave the U.S.! Always give the notice in
writing so you have proof that you did so. E-mail or fax
will do.<br>
Give them your flight into (airline, flight number,
scheduled time of arrival) and your cell phone number.<br>
<br>
Ask the inspector to tell you where in the terminal they
will be meeting you. This is particularly important at
airports - such as JFK - that have multiple international
arrival halls. To the best of my knowledge, JFK is the
only designated wildlife port where there are multiple

USFWS advises that for JFK, "We do not have inspectors
stationed at JFK, however we do have at least one
inspector there during the week going from terminal to
terminal conducting inspections. We use the 48 hour
notice to loosely schedule the inspections, and rely on
the follow up phone calls to let inspectors know
precisely when shipments are ready for them to respond (it
can range from a few minutes to a couple of hours between
a flight landing and the cargo being ready for
inspection). <br>

JFK even has a form they would like you to fill out. I
can't attach it here so e-mail me OFF-LIST if you want a
copy. <br>
<br>

at JFK is (516) 825-3950 x 224. When you arrive, call
this number so the USFWS can have the inspector meet
you. </font><br>

Alternatively, or in addition to this advance notice,
consider having someone at your museum or institution -
perhaps the collections manager - give the advance notice.
