For those images accessed before 12 October 2014, yes, but after
this date I would be careful at the moment:<br>

1. There is a big deal of legal uncertainty with entering into
force & retroactivity: some Providing Countries (e.g.
countries of the African Union) interpret the Nagoya Protocol as
supplement to the CBD, and thus 1993 as relevant date of
enforcement.<br>
<br>
2. Legal uncertainty linked with "new utilisation": images
photographed after 12 Oct. 2014 could be interpreted as accessed
after entering into force of the NP - especially some NGOs
targeting Nat His Collections argue this way - loud & in the
public & with a lot of financial support looking to blame
biopirates.<br>
<br>
3. Material collected & imaged after 12 Oct. 2014 is
definitely covered. <br>
<br>
Don't say that it is illegal to publish those images, just want to
stress that it might be useful to consider ABS related issues
prior to uploading such images ...<br>

Public domain publications are directly challenged in the current
draft of the implementing act of the EU Commission which currently
states that <i>any other form transferring the result of the
utilisation</i> will be regulated & monitored, especially if
the <i>result of the utilisation is sold or <b>i</b><b>n any
other form</b> transferred outside the Union</i>.<span

This <i>transfer of results</i> basically includes everything
because of weak definitions of "utilisation" in the NP could be
providing an image for a book that is sold - and images are
probably the minor issue here. This virtually makes any transfer
of sequence information difficult, regardless if forwarded for
publication or "just" to a colleague for comparison ...<br>
<br>
Especially European Collections should be care- & watchful at
the moment.<br>

not that we would have such a doc that I could share with
you, and beyond illegal image harvesting and copyright
issues which should be clear (e.g the copyright lies with
the photographer and not necessarily with the institution
were he /she is employed at unless otherwise stipulated), I
would like to take the opportunity to point to the fact that
after entering into force of the Nagoya Protocol specific
considerations should be taken on sharing / publication of
pictures:<br>
<br>
The image might show details which fall under "Access
Benefit Sharing" regulations, for example if herbarium
specimens are photographed and the herbarium sheets includes
handwritten information how depicted plants can be used as
remedy (=traditional knowledge).<br>
<br>
Even though the US will not become a party to the Nagoya
Protocol, this might reach out if researchers at your
institution want to conduct research in a providing country
which regulates access to genetic resources and traditional
knowledge.<br>
<br>
Especially mass digitisation projects are pretty much
unaware of this ...<br>
