Bird Conservation Act</a> requires a permit for import of any
"exotic" birds. <br>
<br>
The prohibitions apply to "exotic birds" where the term exotic bird
is defined as " Exotic bird means any live or dead member of the
Class Aves that is not indigenous to the 50 States or the District
of Columbia, including any egg or offspring thereof, <b>but does
not include</b> domestic poultry, dead sport-hunted birds, <b>dead
museum specimens, dead scientific specimens, products manufactured
from such birds</b>, or birds in any of the following families:
Phasianidae. Numididae, Cracidae, Meleagrididae, Megapodiidae,
Anatidae, Struthionidae, Rheidae, Dromaiinae, and Gruidae."<br>

We have always understood this language to mean just what it says
and have been advised numerous times by the USFWS Division of
Management Authority (DMA) that WBCA permits are not need for dead
scientific specimens. Accordingly, we have advised ornithologists
that WBCA permits are needed only for live birds. <br>
<br>
Last week, I was alerted to the fact that a DMA staffer told an
ornithologist that a permit would be needed to import dead
scientific specimens or products manufactured from such birds. I
immediately contacted DMA to ask why this might have been said
(i.e., could it have been a misunderstanding). To my dismay, I
learned that they changed this policy a number of years ago for what
is actually an understandable reason. Basically, when a shipment
comes into the country, the Law Enforcement inspector has no means
of assuring that the item really is a dead museum specimen or dead
scientific specimen or product manufactured from such birds. They
use their discretion to make that determination at the point of
import. <br>
<br>
As I pointed out, relying on the individual inspectors - who have
varying levels of training and experience, not to mention
temperament - is not a great solution. I suggested some solutions
and let's hope that we can work something out. <br>
<br>
<b><font size="+2">Meanwhile, and until further notice, please
always apply for a WBCA permit to import the following species:</font></b><br>

1. Any CITES species except those on the "approved list." The
