I have had numerous questions about this notice so I will try to
clarify.<br>

1. Yes, it is confusing and surprising given that all of you have
been importing bird specimens and samples from species that are not
exempt (well they are, but they aren't) from the WBCA and have not
been having any problems. In fact, I know of only ONE instance in
all these years where a USFWS Law Enforcement port inspector held up
an import (to a high profile museum) on the basis that they needed a
WBCA permit. Not knowing about this change in policy by the Division
of Management Authority, I assumed that the inspector was mistaken,
due perhaps to being new, not well-trained, confused, whatever. I
asked the supervisor to intervene and the shipment went through. I
had assumed that the shipment went through because no WBCA permit
was needed. Now, knowing of this unannounced (to importers) change
in policy, I have to wonder if it is because the supervisor used
his/her discretion to determine that this was a shipment that
qualified for the regulatory exemption. <br>

Herein is the crux of the problem. The decision-making has been
shifted to the Division of Law Enforcement and it has been shifted
to a critical point - the time of import. If the Law Enforcement
inspector decides that you need a WBCA permit, you will be walking
away from that airport without your samples and specimens. Now
you've got to prove - how? no one has any criteria! - that yours is
a shipment that should have been exempt from the permit requirement
under the regulation. Do you really want to walk away without your
research material? Especially if it is perishable?<br>
<br>
If it is a FedEx shipment, it is going to be held up at the port of
arrival. What if you aren't around for some reason and so can't
respond promptly? FedEx will hold that shipment only so long before
it is returned to sender. And again, what if it is perishable? And
again - how do you prove that yours should have been exempt from the
WBCA? It is the very absence of those criteria that caused DMA to
change this policy in the first place.<br>

And if LE refuses to yield, you then have to apply for the WBCA
permit and ........................ (wait). Sixty days? Ninety days?<br>
<br>
So while you haven't had any problems yet, it doesn't mean you won't
in the future. <br>
<br>
I notified all of you so you would be aware of the risk. What DMA
said to me is "We have advised anyone where there may be some
possibility of confusion at the port to come to the Management
Authority for a WBCA permit, just to avoid problems. We can issued
such documents without seeing the CITES export permits (but of
course one would be needed for the export of the specimens from the
country of origin). While I don't recall us ever issuing an import
permit for clearly scientific specimens, we have for museum
specimens that were not part of a COSE. [DMA] will advise [its]
permitting staff that WBCA permits are not needed for clearly
identifiable scientific specimens."<br>

So basically, they are advising me of the risk and I am advising you
of the risk. There are no criteria for "clearly identifiable
scientific specimens." Ya pays yer money, ya takes yer chances.
Considering how important your samples and specimens are to science
and to your own research career, pay the $100 and get the extra
permit until DMA gets this sorted out.<br>

regulation in the works</a> that is scheduled for the public
notice and comment process later this year. The brief description
states, "

implementing the legislation and regulations over the past 15 years,
and also to streamline and clarify certain aspects of the current
regulations." There is no way to obtain the content in advance of
the publication for public comment. I hope that it addresses this
problem. Even if it does, however, we have all seen that it can take
years for final regulations to be published. <br>
<br>
Meanwhile, yes, OC has suggested some potential interim solutions
and I hope the USFWS will consider implementing them as a way to
solve this problem. <br>
<br>
2. Yes, OC has expressed concern about the lack of communication and
implored the agency to let us know of such policy changes. As it
happens, another one came to light yesterday and I"m still trying to
run it to ground. It involves use of the COSE. Please stay tuned.<br>

3. Which species are covered?<br>

"exotic" birds. <br>

The prohibitions apply to "exotic birds" where the term exotic
bird is defined as " Exotic bird means any live or dead member of
the Class Aves that is not indigenous to the 50 States or the
District of Columbia, including any egg or offspring thereof, <b>but
does not include</b> domestic poultry, dead sport-hunted birds,
<b>dead museum specimens, dead scientific specimens, products
manufactured from such birds</b>, or birds in any of the
following families: Phasianidae. Numididae, Cracidae,
Meleagrididae, Megapodiidae, Anatidae, Struthionidae, Rheidae,
Dromaiinae, and Gruidae."<br>

We have always understood this language to mean just what it says
and have been advised numerous times by the USFWS Division of
Management Authority (DMA) that WBCA permits are not need for
dead scientific specimens. Accordingly, we have advised
ornithologists that WBCA permits are needed only for live birds. <br>
<br>
Last week, I was alerted to the fact that a DMA staffer told an
ornithologist that a permit would be needed to import dead
scientific specimens or products manufactured from such birds. I
immediately contacted DMA to ask why this might have been said
(i.e., could it have been a misunderstanding). To my dismay, I
learned that they changed this policy a number of years ago for
what is actually an understandable reason. Basically, when a
shipment comes into the country, the Law Enforcement inspector has
no means of assuring that the item really is a dead museum
specimen or dead scientific specimen or product manufactured from
such birds. They use their discretion to make that determination
at the point of import. <br>
<br>
As I pointed out, relying on the individual inspectors - who have
varying levels of training and experience, not to mention
temperament - is not a great solution. I suggested some solutions
and let's hope that we can work something out. <br>
<br>

always apply for a WBCA permit to import the following
