<p>From our point of view it is early stage even though this
behemoth system designed for commercial importers is already well
underway and scheduled to be completed by the end of the year. In
the stakeholder process, they apparently didn't even know of the
existence of this large non-commercial sector. To the best of my
knowledge, no non-commercial groups were included in the
stakeholder process at the CBP level or at the level of any of the
GPAs (Government Partner Agencies). This is understandable for
agencies such as the FDA, which probably has few if any
noncommercial importers but it makes no sense for agencies such as
the USFWS, which has a very substantial noncommercial import
community.</p>
<p>But what's done is done. The question now is how to deal with it.

<p>To that end, I've had e-mail and phone discussions with CBP about
if/how we - the non-commercial side - can get a delay in
implementation. No promises, but it sounds like we've at least got
a conversation going within CBP. <br>
</p>
<p>I've also got some policy efforts queued up, including a group
outreach to the White House Office of Science and Technology
Policy (this whole thing originated with an Executive Order) and,
of course, emergency appeals to Congress. But if CBP comes back to
us with suggestions for making this work for our sector, then all
to the fantastic and we will of course work with them. <br>
</p>
<p>Now, here's the bottom line. It is not going to go away. And we
are not going to get the non-commercial sector exempted. Why? As I
explained yesterday, this is a national security issue. The CBP
needs to to know what's coming in and who is bringing it in. That
the system was designed for commercial importers and is called
Automated Commercial Environment does not change that. That's
form, reflecting the fact that most imports are commercial. But
the function is to get CBP info prior to import that allows them
to prioritize which shipments they need to pay attention to.</p>
<p>In addition, they want to fold all agencies ("GPAs") into the
system so you will have, when it is fully operational, "one
window" for filing all your declarations. In theory, then, no more
3-177s. The idea is that you will first fill in the info customs
wants, which will also include any info that the agency wants that
overlaps what customs wants (like your name, address, phone, or
things like harmonized tariff code). Then you will go to the
agency specific sections and fill in their "core" info which is
anything they need that does not overlap what CBP wants. <br>
</p>
<p>At this point, I can't get more specific than that, but the point
is that despite the very large initial hurdle, it actually seems
like it will be a good thing in eliminating paperwork and
overlapping and duplicative forms. Time will tell on that. <br>
</p>
<p>Meanwhile, unless you are planning to use a customs broker for
all your shipments, of if you are planning to hand-carry, I
suggest you start the registration process immediately. Expect it
to be slow and frustrating. Step one is to call and ask them to
assign a Client Representative. Don't be surprised if you get
voice mail. I called this morning, got the voice mail, and no one
has called me back yet. <br>

access. Proxy Accounts have more limited roles than TAOs,

which will include all the customs info and the agency-specific
info. Before the import occurs, of course. <br>
