<p>I have had a series of very productive conversations with CBP
over the past two days. They have been absolutely terrific. I will
spare you all the details, especially as everything is still up in
the air, but for now, and particularly for those with imminent
imports/shipments:</p>
<p>1. The CBP isn't even sure that your imports constitute
"entries." Let's hope that is true, because if it is, then the
problem goes away. They are discussing and will let us know.</p>
<p>2. If your imports do constitute entries, then near-term, you
will need to file entries. <b>However - contrary to what I said
yesterday - do NOT attempt to register at this time.</b> It
turns out that registration is for access to the data system and
not for filing entries. I'm continuing to work out how you can
file entries on your own. I was told in no uncertain terms that
every individual has a legal right to file his/her own entry. You
are not required to use a customs broker to file an entry. It is,
however, not a simple task. It is one piece of paper and about 90%
of it is jargon and abbreviations that even I've never seen
before. <br>
</p>
<p>3. We aren't sure how big a problem this is. It came to my
attention only because someone got stuck in Detroit where, it
turns out, they have been enforcing this "entry" thing for a year.
It seemed odd to me that I hadn't heard of problems in any other
port. Apparently, all other ports are still simply accepting your
X on Box 11 of the passenger Customs Declaration form (that
blue-and-white paper you fill in) that says you are bringing in
wildlife or wildlife products. My concern is that even if your
port isn't doing it yet, they will be soon - there is a mandate
from the White House that this whole thing - all agencies - be in
operation by the end of the year. And clearly, we have no way of
knowing when it will actually happen because at least one port
decided to implement before required to do so. Others might do
that, too. <br>
</p>
<p>4. All that being said, if it turns out that you do have to file
entries, I am talking with a nationwide customs brokerage that is
represented on the ACE stakeholder committee that could be the
specialist for our community and would have someone who knows (or
learns) USFWS and APHIS requirements and would also of course file
the "entries." By next Wednesday, I will have information
disseminated to all of you about this brokerage, how to reach
them, the info they will need, and so on. <br>

It
is the FedEx in-house custom brokerage and basically set up to
handle all shipments that require permits, declarations, etc.</p>
<p><i>Caveat - this is not going to work for shipments moving on
CITES permits (i.e., that require validation). I have yet to
see a customs broker handle validation correctly. But for all
else, it should be fine. <br>

this for shipments moving on COSE as well. I will look into
it, but I'd be surprised if they've made an exemption. I asked
to be added to the stakeholder group and they said yes, but
I've heard nothing more since then. <br>

<p>Longer term, your choice will be to continue using FedEx Trade
Network OR register (a labyrinth process) and then file these
things yourself before you head back (or ship back) to the U.S.
I am starting the registration process myself now and hit a
brick wall right away. First thing you do is call and ask them
to assign you a representative. Guess what? Voice mail. But as I
walk through it, I will take detailed notes and share everything
I learn here. <br>

<p>Clearly they didn't meet their own deadlines in some cases and
in some cases, they are ahead of the announced dates, even
enforcing it without advance notice to anyone. APHIS "CORE"
which I assume includes wildlife because the only other APHIS is
Lacey Act, which is for plants, was supposed to have been Nov.
2015. Yesterday, I was told July 23 (three weeks from now). Yet
Detroit, at least, is already enforcing it for APHIS imports. <br>

ago by the APHIS National Import Export Services staff that

<p>So this system requires every importer to report the info.
You can do this is one of two ways: use a customs broker
(which will cost you a few bucks; I'm not clear that any
broker will do it if they haven't actually handled the import
which is generally not cheap and also a serious problem when
it comes to CITES validations. Or you can register and then
file the "entries" yourself. <br>
</p>
<p>In April, I was told it would be months before it would be
required for APHIS info and that we would get advance notice.
Well, technically, it has been months and although I didn't
actually get notice, the system goes into effect for APHIS on
July 23. <br>
</p>
<p>The good news is that once registered, the "entry" you file
covers all agencies. So when USFWS goes into the system, you
will already be there! <br>
</p>
<p>No this will NOT replace any of the agency-specific
documents. This is in addition to all that paperwork. <br>
</p>

<p>It's late, I have Lyme, so I'm not going to start trying it
now but I expect it to be a PITA that is designed for
commercial imports. However, I'll work through it tomorrow,
talk to the agency about any hurdles I can't get past, and get
