<p>1. We are anticipating receipt of a two-page informational
document from CBP in the next week. I will share it here if I can
post attachments. If not, I'll figure out a place to post it and
give you all a link. <br>

<p>2. CBP will offer a <b>webinar</b> for our entire community, <b>probably
the last week in Sept</b>. I'll be away 8/20 - 9/17 but will
post the date/time before I leave if I have it. If not, as soon as
I return. <br>
</p>
<p>3. At the moment, the CBP itself is online in the ACE system and
APHIS is in pilot phase (through third week of August, I think).
It is anticipated that USFWS will join the ACE online entry system
in November. Some USFWS Law Enforcement agents are trying to be
helpful in telling importers that you don't have to worry about
ACE until November. Not so, because you always have to declare for
CBP and may (certain mammals, all birds) have to declare for
APHIS, and some of you even have to declare for CDC (bats, certain
mammals, etc.). <br>
</p>
<p>4. Note that while your imports have no commercial value, they
are still considered commercial by CPB. Only personal use imports
are considered noncommercial. <br>
</p>
<p>5. For now, you have <b>two options for hand-carry </b>(personally
accompanying luggage or carry-on; hand-carry means NOT CARGO):</p>
<p>(a) For ACE and APHIS, use a Customs broker to do a formal entry.</p>
<p>Yes, it will cost you money and yes, you will have to educate the
broker to be sure that they provide the correct information. For
the bird people - feel free to have the broker contact me and I'll
be sure that they know/understand the APHIS terminology (most
don't in my experience) and provide the right answers so that you
don't end up in a bind at the port with someone thinking (for
instance) that you are importing a select agent. <br>
</p>
<p>If you use a broker, the broker does the filing and gives you a
CBP entry number. <br>
</p>
<p>You give the Customs agent at the airport that CBP entry number.</p>
<p>The Customs agent will look it up to be sure that the relevant
agencies have signed off.</p>
<p>There will be no change in inspection - the customs brokers would
be notified by the agency if inspection is needed (the info would
be in the entry document itself).</p>
<p>For USFWS, as of now, no change from the way you have been doing
it. Notify them (not required, just best practice - makes your
life easier!) before you even leave the U.S. and again at least 72
hrs (or whatever it says on your permit) before your return. Most
if not all USFWS Designated Wildlife Ports have a short form to
fill in with your arrival info. Depending on where you are before
returning to the U.S. (i.e., how much access you have to fax
machines or scanners) it is probably easier to fill it in and
leave it with someone stateside to file on your behalf. <br>
</p>
<p>In November, or whenever USFWS goes online with ACE, then you
won't be able to do this anymore. In fact, "hybrid" entries will
be prohibited. If all the relevant agencies are online in ACE,
then your entire entry for all agencies will need to go through
ACE. You won't be able to use ACE for Customs and paper for one or
more other agencies. <br>
</p>
<p>(b) Call the port of entry prior to your departure from the U.S.
You will need to get the OK from:</p>
<p>- CBP AQI (or OFO = Office of Field Operatons)</p>
<p>- APHIS <br>
</p>
<p>- and eventually USFWS as well, once they are online with ACE</p>
<p>to do an informal entry at the time of arrival</p>
<p>If any one of them says no then you have to go the formal entry
route via a customs broker</p>
<p>If they all say yes, then you can do informal entry. I think but
I'm not sure that it is form 3461</p>

<p>Still working on verifying that and on translating the codes for
the info they need. <br>

<p>And that can be filed on the spot, but again, that's subject to
all relevant agencies having agreed in advance to allow informal
entry. <br>
</p>
<p>In terms of actual arrival procedures, then, this would be pretty
much what you have been doing all along with the additional steps
of getting permission in advance to do informal entry and hving
this additional paperwork with you. <br>
</p>
<p>6. Options for <b>cargo</b>:</p>
Use a customs broker. As I've explained before, regular FedEx has
been handling your USFWS and APHIS paperwork. I am not sure if they
are handling ACE entries or not. If they are, fine. If not, then you
can use any customs broker you like or FedEx Trade Network, which is
the FedEx in-house customs broker. <br>
