<p>I have over the years recommended that you consider using FedEx
Trade Networks rather than FedEx Conventional to handle any
shipments that require USFWS clearance because of the intricacy of
the USFWS permit systems. Now, the entire situation is complicated
by the requirement for use of the International Trade Data
System/Automated Commercial Environment, whereby all declarations
- Customs and any "Partner Government Agency" must be made through
this single window (ACE) to which you do not have access.</p>
<p>For hand-carries, the advice about using a broker continues. No
change there.</p>
<p>However, after a long and informative talk today with
representatives of both FedEx Conventional and FedEx Trade
Networks, the advice is to <br>
</p>
<p>KEEP USING FEDEX CONVENTIONAL UNTIL FURTHER NOTICE.</p>
<p>Important points to remember:</p>
<p>1. This will work ONLY if you mark the air waybill correctly. Not
just the correct harmonized tariff code, but also the word
WILDLIFE. As in the past, I strongly recommend that you mark both
the air waybill (description box in the lower left-hand corner)
and the box itself with the words:</p>
<p>WILDLIFE::USFWS CLEARANCE REQUIRED::(PERMIT TYPE) OR (NO PERMIT
REQUIRED)</p>
<p>The FTN and FedEx Conventional reps confirmed that this is how
you should mark the air waybill. <br>
</p>
<p>I also recommend that you mark the box itself on at least four
sides. <br>
</p>
<p>The reason this will work is that FedEx Conventional has a system
called "Express Clearance Operation" and if the waybill is marked
correctly, ECO will handle the USFWS and APHIS clearance
processes. That's what they've been doing all along.</p>
<p>It turns out that the reason they are not able to give you
evidence of clearance is that this is basically done manually. The
USFWS and APHIS do not have an "electronic handshake" back to
FedEx that can be forwarded to you.</p>
<p>Once ACE is fully operational, however, you won't need it because
the fact that an entry was issued will mean that all required
clearances were obtained. <br>
</p>
<p>It is going to take a while to get there....<br>
</p>
<p>2. Don't assume that because your shipment has a value of under
$800 and therefore would be eligible for a Section 321 exemption
under the Customs regulations that none of this applies to you.
Based on ongoing discussions with the CBP and USFWS, and confirmed
today by FedEx, whenever your import requires one or more "Partner
Government Agency" declarations, the 321 exemption (the informal
entry process if hand-carrying or entry on the manifest if
shipping) does not apply. It is apparently more complicated than
that and I've written it up, but I'm awaiting confirmation from
CBP that I've got it right before sending it out to you. <br>
</p>
<p>For now, assume that if your import requires a declaration for
one or more government agencies other than Customs, the import
will require an entry via the ACE system. <br>
</p>
<p><br>
</p>
<p>It is possible, given the additional complexity, that FedEx is
going to be asking you to set up a specialized account called a
"Customized Processing Account." Doing so will allow you to
continue using FedEx express but have increased assurance that the
clearance processes will be handled correctly. Should that occur,
let me know. Based on the conversation today, I think this idea -
together with some others that we brainstormed and that FedEx will
be discussing - will be the solution with regard to shipments of
wildlife research material. I will keep you posted as I hear more
from FedEx. <br>
</p>
<p>FYI, they too are hearing that there may be a simpler approach
for the 321 imports in the future - but perhaps two years down the
road. <br>
</p>
