<p>Subject: Issuance of Designated Port Exception Permits for Import
at Non-Staffed Ports <br>
</p>
<p>Background: Service regulations under 50 C.F.R. Part 14 allow for
the issuance of a permit
authorizing importation and exportation of wildlife at one or more
ports not otherwise authorized
when certain criteria are met. The issuance criteria for the
Designated Port Exception Permits
(DPEP) include the availability of a Service officer.
As the Service moves forward with implementation of the
International Trade Data System
(ITDS) and begins to pilot the FWS Import Message Set submitted
through the Automated
Commercial Environment (ACE), it is critical that our wildlife
inspectors be staffed at ports of
clearance to process shipments and function effectively in this
new single window environment. <br>
</p>
<p>Action: Effective immediately, the Service will no longer issue
DPEP’s to authorize a nonstaffed
port when the applicant is required to file a CBP entry for any
import activity.</p>
<p><br>
</p>
<p>Commentary: as I mentioned earlier, I have a briefing sheet in
draft, under review by CBP, about when a CBP entry is required and
when it is not. As soon as I get the green light from CBP, I will
post it here.</p>
<p>Based on your feedback on the use of designated port exemptions,
I've always counseled against using nondesignated ports. Nearly
every report that has come my way has been negative - agents not
showing up, showing up very late, not having adequate training,
and of course, the added cost. So just not a great idea. Now, this
additional complexity means that if you are mistaken about whether
or not you need a CBP entry for a hand-carry, you would get to
your non-designated port only to find out that you can't get into
the country with your import anyway. <br>
</p>
<p>I'm thinking that this probably also applies to the use of the
U.S. Postal Service because I doubt that they can or will do ACE
entries. I've inquired. Stay tuned. <br>
