<p>1. Use of CITES COSE when a country has been suspended</p>
<p>We have been waiting since early May for a response from the
USFWS Division of Management Authority as to when the COSE may be
used when trade from a particular country has been suspended. At
that time, we were told that DMA was consulting with the USFWS
Division of Law Authority and we'd hear more in a week's time.
Despite several reminders, we've heard nothing more. <br>
</p>
<p>2. Changes in CITES listings</p>
<p>We asked the CITES Animals Committee to de-list four species on
the basis of taxonomic reclassification. They declined on the
basis that they don't have a current taxonomic authority to work
with. Indeed, they are using a 30+ yr old taxonomic authority.
They feel they have to evaluate which of several current
authorities they should use and they haven't got the funds to do
that work or have it done. Prior to the COP in September, OC wrote
to the CITES Chief of Scientific Services (at the CITES
Secretariat) to determine what might be done to resolve this
situation. No response received yet. The request was sent again
today.</p>
<p>We also asked the USFWS Division of Scientific Authority to
re-submit the request to the CITES Animals Committee. <br>
</p>
<p>3. Petition to suspend/revoke validation requirement<br>
</p>
<p>OC and ASM filed a petition back in September 2014 to ask that
the validation requirement be revoked or suspended. We were told
that it would be addressed in a CITES regulatory revision in 2015.
No, that is not a typo. In 2015. By way of context, note that the
USFWS has to revise the CITES regs after every Conference of the
Parties (COP), to incorporate resolutions and so forth, coming out
of that COP. The most recent COP took place in Sept. 2016, so you
can reasonably conclude that the very under-staffed agency is
moving even more slowly than is the norm. We will keep on them but
it is likely that they won't address it until they propose CITES
regulatory updates in ....? Late 2017? Things are always even
slower after an election, and especially if people with little or
no subject-matter or process experience ... all of whom will be in
the "surname" process for approval of regulatory changes ... are
appointed. <br>
</p>
<p>4. On ACE <br>
</p>
<p> OC has had dialogue with the USFWS about that agency's
implementation of ACE. We were hopeful, based on a conversation
with the USFWS and CBP, that it would be possible to avoid ACE for
the "Section 321" imports (value under $800) by virtue of the use
of e-decs. Unfortunately, it does not appear that this will be the
case for some time. When the USFWS designed its ACE system
("question set") it did not include a means by which the e-dec
confirmation number could be entered into ACE as opposed to
actually entering all the data in ACE itself. They are still
looking into that but for now, ACE it is.</p>
<p>4. On ACE and the use of the U.S. mail<br>
</p>
<p>The OC has been trying for some time to determine if the USFWS
actually allows the use of the U.S. mail for imports that require
permits. We have had a petition for regulatory clarification
pending since June 2014 (the Constitution protects your right to
seek redress but doesn't require that the government actually
reply to your petition). <br>
</p>
<p>All this is probably moot now as a result of ACE since we have no
indication that the U.S. Postal Service can or will handle the ACE
entries. <br>
</p>
<p>5. On ACE and FedEx</p>
<p>OC continues to explore the potential for the Customized
Processing Accounts to resolve the problem of FedEx handling the
ACE entries correctly. There is an additional cost but we don't
know yet what that cost is. <br>
</p>
<p>6. On designated port exemptions</p>
<p>The USFWS confirms that you can continue to use existing
designated port exemption permits. They are not renewing or
issuing new DPEPs for non-staffed ports. We continue to issue and
renew DPEPs for staffed ports at this time. <br>
