<p>1. The problem in Atlanta has been resolved. It took going all
the way to the CBP Chief for that port but it is
resolved....CAVEAT...as to imports that require only USFWS and/or
APHIS clearance. If your hand-carried (i.e., personal accompanying
baggage) import requires CDC clearance then you are still stuck
with having to do ACE through a broker.</p>
<p>Why? <br>
</p>
<p>Because the CBP has decided that if the "partner government
agencies" will allow the use of paper forms or e-decs for a
hand-carry import, then you don't have to do an ACE entry.</p>
<p>I'm still trying to determine if the CDC will allow paper forms
but I seriously doubt it as they have no presence at the ports. <br>
</p>
<p>Does your import require a CDC permit? tool</a> that walks you through it but it is problematic. If you
answer "yes" or "don't know" to the question "does the material
contain or is it suspected of containing an infectious biological
agent that is capable of causing disease in humans or is being
tested for a specific biological agent?" it is going to tell you
that you need a permit. However, it fails to state that all avian
material and some mammalian material is controlled under APHIS
permits, not CDC permits. <br>

<p>Another section of the CDC permits page states that you do not
need a permit if you are importing: <br>
</p>

0);">Animal or animal product being imported for educational,
exhibition, or scientific purposes and is accompanied by
documentation confirming that the animal or animal product is
not known to contain (or suspected of containing) an infectious
biological agent or has been rendered noninfectious.</li>

<p>But again, this would not even be an issue for materials that are
controlled under APHIS permits.</p>
<p>I am trying to reach CDC to ask them to revise this information.</p>
<p>Note that it is conceivable that in the future, you might need a
CDC permit for imports that currently do not require them. The CDC
and APHIS will both embargo imports on a temporary basis if a
pathogen emerges as a threat to either human health or
agriculture, or both. They will then determine which agency should
control those imports. Generally, CDC takes the lead on pathogens
that are of primary concern for human health and APHIS will take
the lead on pathogens that are of primary concern for agriculture.
This is exactly what happened with avian influenza - the CDC
embargoed all imports and eventually, they decided it wasn't that
great a threat for humans and so control went to APHIS.<br>

<p>2. A hand-carry import of avian material through Houston using
e-decs (or paper 3-177) and a paper APHIS VS16-3 and associated
paperwork went smoothly.</p>
<p>3. Please continue to let me know if you encounter any problems
with hand-carries. I'm having doubts about this advice from CBP
that you contact the CBP in advance. As we are learning, the CBP
staffers don't seem to be well-educated about natural history
imports (and no reason they should be). It is for that reason that
we continue to ask for guidance from the CBP headquarters. <br>
