Let's just say it depends on where you are publishing them. They are old
enough to be considered public domain, but as Kineclubbers know from past
discussions there is no such thing from the point of view of Japanese
studios.
If you are publishing in a film journal from the US, there is a good chance
they claim educational fair use and won't ask you for proof that it's
cleared. In that case, just go ahead and publish it. If you have to clear
them, good luck. With Shochiku, they may ask you for money (even if they
don't have the legal right), but I've never heard of anyone being denied
permission. Has anyone had problems?
Toho is another story.....
