This is an issue I'm also interested in so I'll add perhaps irrelevant comments. Irrelevant because I was pursuing permission to publish screenshots of wartime footage NHK has posted on its web archives (not on DVD), the only version of the video NHK will allow to me for free. I asked NHK if I could use screenshots in an academic article. I was told that under the copyright law art. 32 著作権法第三十二条, which covers quotations, I was permitted to use screenshots of that material to the extent necessary and justifiable by the contents of the article. They said nothing about the age of the video. However, I also contacted a book editor to ask whether I could take a photo of a wartime children's drawing in a book he published ten years ago and use it for the same purpose. He asked the publishing company and told me it might not be permissible. I'm now seeking clarification from the publisher on that.
