Description: One of the most controversial U.S. legislative proposals
regarding Native Hawaiians is currently before the U.S. Senate: The
Native Hawaiian Reorganization Act. Beginning in the 106th U.S. Congress
in 2000 and continuing through the present in this 111th Congress, U.S.
Senator, Daniel Akaka (D-HI) has sponsored this bill in order to secure
the recognition of Native Hawaiians as an indigenous people who have a
"special relationship" with the United States and thus a right to
internal self-determination akin to tribal nations. While there is
liberal support for the bill in the face of conservative opposition, the
current state-driven push for federal recognition is problematic for
outstanding Hawaiian sovereignty claims. The history of the Hawaiian
Kingdom-recognized as an independent State by all major global powers
throughout the 19th century-provides Kanaka Maoli (indigenous Hawaiians)
with a rare legal genealogy. As a result, many Hawaiian independence
activists contest the political limits imposed on indigenous peoples,
while some are going even further by entirely dispensing with the
category of indigeneity as a means of relief from the political
condition of indigeneity.
