I would tend to agree with Frank on this issue – the 3-177 process hinders scientific research, though it’s hard to say how much of an impact it really has. I personally find the process annoying and a bit arbitrary, but I think us museum folks have a very heightened awareness of these regulations compared to the general scientific community because we ship our irreplaceable objects across borders regularly. It’s worth noting also that there’s likely widespread non-compliance with these regulations already. I’d posit that a significant portion of scientists currently ignore these regulations either willfully or due to ignorance. I’ve encountered plenty of U.S. scientists that collect ethically (i.e. with permits) in foreign countries that had never even heard of the 3-177 process, let alone submitted an eDec.
That being said, I share the concern that others have raised – I don’t know if it is wise to publicly imply that the museum community / SPNHC is anti-wildlife regulations. If we consider (and I think this is pretty obvious, personally) that the political forces in the U.S. that are seeking to carry out this deregulation of wildlife trade and defang the USFWS are bad faith actors generally aligned with commercial interests, it may not turn out in our favor to hop on their bandwagon just because we think it might yield one favorable result.
Does anyone have data on the actual effects of these rules, in terms of enforcement actions on both commercial and nonprofit entities, and also in terms of the burden they have on museum staff time? Maybe we could have a poll sent out that could quantify the impacts of the current system on SPNHC members? Like “how much time do you spend on 3-177s annually, how many important shipments have been lost or damaged due to this process”, etc.

The reason is the increasing interest to regulate commercial imports from Asia which lead to major changes in the regulatory system (eDec, in-advance declarations, handling processes). You are absolutely right with your observation that this is a larger issue, and that the definition of and pure focus on trade causes additional hiccups, which are not useful. Therefore, we need a holistic view, and we try to align our efforts together with our European Legs & Regs group under CETAF.
Science friendly interpretations and processes are in place. However, is is quite common that existing laws are evaluated and amended every five to ten years. For example, we did invest a lot of time to adjust animal-by-product laws in the EU to smoothen imports 10 years ago, but face currently new challenges. One of them is, that scientists also need follow the agreed path, act accordingly and develop an understanding for these regulatory processes, and why they are there.
Phrasing it diplomatically, this is not only the case, and there is obvious room for improvement. Improving processes requires not only looking and understanding both sides of the medal, it also means that scientists do adapt to the regulatory environment they work in.
We are looking into this and keep you posted, and for sure include any updates in our Shipping Workshops that are continuously update since 2010.

I agree with Cody. None of us like to do eDecs but we recognize that the process is intended to prevent wildlife trafficking. It is important as a scientific community that we continue to support such regulations.

Mike Ivie talked about National Park Specimens and I outlined a game plan last year. I suspect no one followed up on it. I would but I’m engaged in several other projects no one is interested in and didn’t have time. (I did email some people but never heard back).
If we actually knew what we were talking about, it would help. Again, I would suggest that we all agree, we are scientists, not lawyers. We need to consult a professional and not pretend we know what we are talking about.
Concerning USFWS 3-177, we need to proceed cautiously. Our view is dead invertebrates. What about tigers?
If we suggested anything, it would probably be best to state NON-CITES INVERTEBRATES often.
