[Nhcoll-l] FW: REPOST: New law regarding collecting and collections in Germany

Dear all,

this refers primary to the national implementation of a EU law that 
tries to regulate the fine arts marked and especially the illegal 
trading of illegal cultural heritage objects and artefacts (e.g. from 
archaeological sites as Palmyra or artefacts that recently disappeared 
in Egypt, Syria or Iraq)

However, as we understand our collections as part of the cultural 
heritage (which they are), there is a linkage even though this new law 
(at the moment) might only loosely affect us in terms of collection 
objects. One exception surely is palaeontology.

The second point we currently can't oversee (simply because the 
implementing acts are not ready by now) is if we will face indirect 
troubles when sending our normal specimens (loans, exchanges, etc.), 
simply because for various reasons we encouraged colleagues to identify 
any collections objects that are shipped over international borders by 
using the international harmonised custom tariff code HS 9705.00.

As a matter of fact, this is a rather broad and inclusive code, 
comprising all sorts of collection and collectors objects, and 
especially artefacts that are meant to become more closely monitored 
when crossing international borders.

If the EU introduces sharp monitoring & customs checks, shipments might 
not only be delayed, but some postal carriers could exclude such 
consignments from transportation, to avoid any risks, delay in process 
flow or bad reputation for the own company.

Colleagues of the German DNFS Consortium of Natural History Collections 
are currently trying to get a grip on this, but we entered the political 
discussion at a very late point and (so far) had little political 
influence. It would definitely be worth if other EU-colleagues could 
check the current situation inside their countries and keep the 
community posted if similar laws are implemented in their countries. 
This would allow us to coordinate efforts for our political lobby work.
